Tien Lang District authorities has revoked their decision to forcibly confiscate Vuon’s land

The move will mean the court case that was set to get underway in Haiphong will not be heard.

Between 2008 and 2009, Tien Lang authorities issued two separate decisions to reclaim around 40 hectares of Vuon’s land in Vinh Quang Commune, claiming that his land use agreement had expired.

They issued another decision on November 24, 2011 to coercively reclaim Vuon’s land and carried out the forcible eviction on January 5, leading to a violent confrontation with the farmer and his family that left six local police officers injured.

According to the prime minister’s recent intervention, the first two decisions were against the Land Law 2003 and the Government’s decree that guides the implementation of the law, making the local decision illegal.

The PM requested municipal authorities to deal with the aftermath of the case and facilitate Vuon’s continued use of his land.

To enforce the PM’s request, Haiphong and Tien Lang authorities held a meeting to revoke their previous decisions. The PM’s other rulings on the case must be enforced prior to March 31, 2012.

On February 13, the Supreme People’s Court issued a decision to overturn the verdict arrived at by Haiphong City’s Tien Lang District Court, and the city People’s Court’s decision to suspend Vuon’s appeal hearing against the district authorities’ withdrawal of 40 hectares of land allocated to him in 1993 and 1997.

The chief judge of the Supreme Court concluded that both the administrative verdict and the suspension decision be nullified and demanded that the case be re-investigated.

On February 14, the Tien Lang District’s Party Committee and government announced their respective decisions to suspend Phan Dang Hoan, Secretary of the Vinh Quang Commune Party Committee, and Le Thanh Liem, Deputy Secretary of the Party Committee and Chairman of the commune People’s Committee for their wrongdoings in the case.

On February 7, Tien Lang District People’s Committee Le Van Hien and his Deputy Nguyen Van Khanh were also suspended.
