The recently-issued regulation on surrogate pregnancy stipulates that woman who make surrogacy arrangements must already have children and can only make such arrangements once in their lives.
Women allowed to make surrogacy arrangements only once
The State Presidential Office held a meeting on July 10 to announce 11 laws that have recently been approved by the National Assembly, including the amended Marriage and Family Law.
The law stipulates several restrictions on the conditions for surrogate pregnancies, allowing cases involving humanitarian purposes, it must be voluntary decision and have written agreement. Those who agree to surrogate pregnancies must be a relative of either an infertile wife or husband.
Also, if the surrogate is married, she must have written approval from her spouse.
The law also stipulates that an infertile couple not already have children and get medical verification that the couple is either infertile or the woman is unable to give birth. From the moment of birth, the law says, the infertile couple gains full custody of the child.
The regulation will take effect January 1, 2015.
