Nearly a half of decisions in land-related lawsuits were wrong, according to recent reports.

The results were delivered by local authorities at the National Assembly session on the issue held on November 7.
Wrong decisions undermine authorities
According to the NA’s Standing Committee, from 2003-2011, state administrative agencies at different levels received and dealt with over 1.2 million letters of complaint and denouncements, 70% of which were related to land issues.
Statistics from localities nationwide showed that 47.8% of the decisions on land-related lawsuits were wrong.
“The situation has revealed several shortcomings in decisions related to land disputes by local authorities,” said Nguyen Van Giau, Chairman of the NA’s Economics Committee.
Giau pointed out many wrong decisions by authorities at different levels in terms of land reoccupation, compensation, resettlement and land disputes.
Some localities had not strictly complied with required processes in granting land use right certificates, he noted.
Inspections for the 2003-2011 period helped detect and reimburse VND1.85 trillion (USD88.68 million) and 4,800 hectares of land involving over 6,900 people. The inspection agencies proposed punishments for 6,650 local officials and asked for investigations into 380 cases with 665 offenders.
Measures
Many NA deputies have raised concerns over the high rate of wrong decisions related to land issues.
Deputy Nguyen Thi Kha from the southern province of Tra Vinh said the erroneous decisions had caused serious consequences and affected people’s confidence in local authorities.
Deputy Dinh Thi Phuong Lan from the central province of Quang Ngai attributed the situation to the government’s lack of supervision over local authorities.
She proposed that the government restrict power of authorities in terms of land withdraws to ensure better decisions.
Meanwhile, deputy Than Duc Nam from Danang City recommended that the government diversify the forms of land compensation to ensure the interests of those who have their land revoked.
Deputy Nguyen Thai Hoc from Phu Yen Province was doubtful about the information that 6,650 officials had been punished for their wrongdoings. He said that the real number should have been much higher.
He suggested removing officials who worked in land related issues and fining them for wrong decisions.
