Vietnam to inspect firms using pirated software

Vietnam’s Ministry of Culture, Sports and Tourism will launch inspections targeting companies and individuals suspected of using pirated software and illegally distributing copyrighted content online.

The ministry has issued a plan to establish inspection teams to monitor compliance with copyright and related rights regulations among businesses, organisations and individuals.

The inspections will target entities operating in digital content, media, advertising, film distribution, music, software, information technology, e-commerce, internet services and social media that exploit copyrighted works and programmes online.

Authorities will review the use of copyrighted works, audio and video recordings, and broadcast programmes, as well as obligations related to licensing and royalty payments.

Inspection teams will also examine whether companies are using properly licensed computer software.

Activities involving the uploading, copying and distribution of content on websites, fan pages, video channels and applications will fall under scrutiny, alongside livestreaming, online broadcasting and the unauthorised sharing or communication of copyrighted works to the public.

Officials will additionally inspect legal documents including business registration certificates, sector-specific operating licences, copyright transfer agreements, exploitation authorisations and royalty payment records.

If violations are discovered, inspection teams may issue formal reports, request the removal of infringing content and recommend administrative penalties or refer cases to competent authorities for further action.

The ministry said inspections must be conducted in accordance with the law and ensure objectivity, transparency and minimal disruption to normal business operations.

Authorities said enforcement efforts would focus on sectors and activities considered at high risk for copyright violations in the digital environment, while ensuring close coordination between agencies involved in inspections and legal enforcement.

Earlier, on May 6, the Copyright Office of Vietnam urged individuals and businesses not to use unlicensed software or illegally exploit copyrighted works, performances, audio recordings, video recordings and broadcast programmes.
