Municipal police say that To Quang Toan, a guard on the train, along with four bridge guards, should be brought to trial for criminal negligence.
They also recommended legal procedures against two car drivers, Nguyen Hung Quoc and Tran Minh Chau, for blocking railway traffic.
On February 6, 2011 the northbound train, SE2, smashed into six cars while passing over the Ghenh Bridge, in Bien Hoa City, Dong Nai Province.
Nguyen Van Cong, Spokesman for the Ministry of Transport, said that this was the most serious accident to occur during Tet.
The bridge shares traffic with cars and motorbikes. According to the Dong Nai Traffic Police, the responsibility for the accident might lie with the guards at either end of the bridge, whose job it was to clear away motor vehicle traffic before trains approached. It was failures in this system that caused the fatal accident.
