Lawyer speaks of difficulty in recovering embezzled funds

A lawyer from the Hanoi Bar Association said that recovering money embezzled by the former leaders of the Vinalines posed challenges.

Hang Nga, of the Hanoi Bar Association said in an interview that recovering money embezzled by Duong Chi Dung and his accomplices in the Vinalines case posed challenges.

Former chairman, Duong Chi Dung, and former general director, Mai Van Phuc, have just been sentenced to death for intentionally violating State regulations on economic management which caused severe consequences.

Dung and Phuc were asked to pay back VND10 billion (USD470,000) they had embezzled in addition to a compensation of VND100 billion for damages.

What do you think about the verdict?

The verdicts shows the government's effort to prevent corruption. But I think it will be impossible to ever retrieve the money.

The value of their three houses together is much less than the required sum. Also, the culprits were just handed death sentence. How could money be retrieved from them once they are put to death? The death sentence means that they will not have to comply to the other part of the verdict.

Do you mean the money will remain lost?

Yes. In normal economic circumstances, the court would make the offender pay a huge sum for compensation. But in this case it is different because of Dung and his accomplices caused such severe damage. This is the reason I agreed with the death sentence.

Is there anyway to recoup these funds?

We can do nothing but follow procedure. Once the verdict goes into effect, the Civil Judgement Enforcement of Hanoi will hear complaints from the victims.
