Following the 13th administrative review on September 13, the US Department of Commerce (DOC) has imposed a USD2.39 per kilo anti-dumping duty on frozen Vietnamese catfish fillets imported from August 1, 2015 to July 31, 2016. The USD2.39 anti-dumping duty is three times higher than the imposed duty during the 12th administrative review.

According to VASEP, the new duty violated regular anti-dumping rules.

The DOC said that Go Dang Seafood Joint Stock Company (Godaco) hadn't complied with the procedure or provided the necessary documents. However, VASEP said that Godaco was well-prepared and had provided all documents related to producing and trading. Godaco also answered every question by DOC on time so its anti-dumping tax should have been small.

VASEP said it was unprecedented and unreasonable that DOC calculated the average duty rates for companies that receive separate rates based on the adverse facts available, facts available with adverse inferences to uncooperative parties, even though those companies had provided all required documents on time.

VASEP demanded the DOC to carefully examine Godaco's documents to accurately calculate the taxes and stop using the adverse facts available as the companies had complied with the laws.
