Panamanian ship detained at Vietnam port over cargo damage claim

Panama-flagged vessel Zhi Ying Chang Shun has been detained at Quy Nhon port in Vietnam’s Gia Lai Province to settle a cargo damage claim filed by a Vietnamese company.

The People’s Court of Region 1 based in Gia Lai Province confirmed the news on October 16 following a request from the PetroVietnam Fertilizer and Chemicals Corporation (PVFCCo).

PVFCCo on October 6 filed a petition seeking the detention of the vessel to address a cargo damage claim valued at approximately USD 300,000.

According to PVFCCo, the Zhi Ying Chang Shun transported 8,800 tonnes of Ammonium Sulphate fertilizer from China to Quy Nhon under a purchase contract with Samsung C&T Singapore Pte Ltd.

 When the ship arrived on October 1 and unloading began, the cargo owner discovered that part of the fertilizer in hold No. 2 had been contaminated. The following day, a delay in closing the hatch covers during unloading operations caused goods in holds No. 1, 2, and 3 to become wet for about 25 minutes, leading to significant losses.

After reviewing the evidence and determining the need for an emergency temporary measure, the People’s Court of Region 1 issued a decision to detain the Zhi Ying Chang Shun for a maximum of 30 days.

The court also decided to freeze VND 30 billion (approximately USD 1.2 million) belonging to PVFCCo until a release order is issued.

The decision has been forwarded to the Quy Nhon Maritime Administration, relevant parties, and the People’s Procuracy of Region 1, Gia Lai for implementation in accordance with the law.
